1. About NightPick

NightPick is a social platform that allows groups of users to discover, discuss, and synchronise the playback of media they choose to watch together. NightPick does not store, host, or re-distribute any audio or video files. All media is streamed from external third-party sources; NightPick only coordinates the playback experience.

2. User Responsibility for Content

By using NightPick you agree that you, not NightPick, are responsible for your activity on the platform, including any links or content you access or share with others. You represent and warrant that your use of the platform does not violate any applicable law or the rights of any third party, including copyright, trademark, or privacy rights.

3. No Hosting of Copyrighted Material

NightPick functions solely as a synchronised playback coordination tool, similar in nature to screen-sharing. We do not upload, transcode, cache, or re-distribute any third-party media files. The platform is not a streaming service and derives no revenue from any content shared by users.

4. Prohibited Uses

You may not use NightPick to:

• Share links to pirated, stolen, or unlicensed copyrighted content.
• Harass, threaten, or harm other users.
• Distribute malware, phishing links, or spam.
• Impersonate any person or entity.
• Violate any applicable local, national, or international law.

5. DMCA / Copyright

If you believe that content accessible via NightPick infringes your copyright, please send a written DMCA takedown notice to nightpickofficial@gmail.com. Include a description of the copyrighted work, the infringing URL(s), your contact information, and a statement of good faith belief. We will respond promptly.

6. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. NightPick reserves the right to suspend or terminate accounts that violate these Terms without notice.

7. Disclaimer of Warranties

NightPick is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service. Your use of the platform is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, NightPick and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform or any content shared through it.

9. Age Requirement

You must be at least 13 years of age to use NightPick. If you are under 18 you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
